If your Personally Identifiable Information(PII) has been compromised during a traffic violation or accident and you have received information that your driving privilege has been or is subject to being canceled, denied or suspended as a result of the Identity theft, do the following:
- File a police report with your local law enforcement agency.
- Under Colorado Revised Statutes (CRS) section,16-5-103, a Motion may be filed with the court to determine factual innocence for a person whose identifying information has been mistakenly associated with an arrest, summons, information, indictment or conviction. Visit the Colorado Judicial Branch for more information on how to file a motion for factual innocence.
- Once you have received your court order of factual innocence you will provide a copy to the Driver Control section of the Division of Motor Vehicles (DMV).
- If your identity was used during an arrest, contact the Colorado Bureau of Investigation,(CBI) Identity Theft and Fraud Hotline toll free at 1-855-443-3489. ,The CBI also offers a Victim Assistance Program for Identity Theft victims. Contact the Victim Assistance Program at 303-239-4649, or visit their Facebook page.
If you have reason to believe that someone has obtained a Colorado permit, driver license or identification card using your PII, do the following:

Obtain documents establishing your full legal name, date of birth and identity, and provide as many details as possible including suspect information if known.

If your personal identification number (PIN) has been compromised you may request a new PIN. You will need to apply for a new PIN in person at any DMV office. You will also need to provide a police report to DMV personnel.

If you have reason to believe you have been a victim of identity theft or your personal identifying information has been compromised and it has impacted your motor vehicle record you can contact MVIU to determine if your case meets the requirements for an investigation. If you have reason to believe that your Certificate of Title paperwork has been compromised and it has impacted your motor vehicle registration process you can contact MVIU to determine if your case meets the requirements for an investigation.
