Out-of-State Drivers and DUI

If you received a DUI in Colorado but live out-of-state, there are important things to know.

Important Information

  • If the Officer takes your driver license, you will be given a 7-day paper authorization to continue driving.  You must also request a hearing with the Department of Revenue, Hearings Division within  7 calendar days and may qualify for a temporary authorization to continue driving until the hearing.
  • The 7-Day Rule: When an officer confiscates your license and gives you a notice of revocation, you have 7 calendar days from the day of the event to request an Expressed Consent Hearing with the Department of Revenue, Hearings Division.
    • If you request the hearing, you will receive a temporary driving permit valid until the hearing date, if you are eligible.
    • If you miss the 7-calendar day window, you automatically waive your right to a hearing, and your license will be revoked.
  • If your driving privileges are revoked due to a DUI offense and you live out of state:
    • You cannot reinstate your driving privileges in Colorado until the revocation period is over. The hold in Colorado will remain on the National Driver Registry until you meet all reinstatement requirements and the revocation period has ended.
    • If you have an interlock requirement,  you can file the Non-Ownership Affidavit (DR 2056) with the department.  The affidavit will comply with the interlock install requirement and restricted interlock agreement requirement.  If you file the DR 2056,  you cannot operate a vehicle in Colorado without an interlock device installed.
    • If you have an SR22 requirement,  you can file the Out of State Residency Affidavit (DR 2680).  Remember,  all three sections on the affidavit must be completed.
    • If you have a Level 2 Education and Treatment requirement.  The Colorado DMV will accept treatment hours, including an assessment from a behavioral health clinician completed out of state.  Please refer to form DR 2048 for more information.
    • Pay the $95 and $25 reinstatement fees. The fees can be paid online with myDMV here.
  • You can find all forms in our Forms Library here.
  • Please keep in mind that an out-of-state resident cannot apply for early reinstatement.  You must wait until the revocation period is over.
